These Terms constitute a legally binding agreement between you and Bell3.

b. You are solely responsible for all activities that occur under your account. You agree to notify Bell3 immediately of any unauthorized use of your account or any other breach of security.

c. Bell3 reserves the right to suspend, disable, or terminate your account at any time, with or without notice, for any reason, including, but not limited to, violation of these Terms or engaging in any activity that is harmful to the Website  and Mobile App or its users.

User Conduct

a. You agree to use the Website and Mobile App in compliance with all applicable laws, regulations, and these Terms.

b. You will not use the Website and Mobile App to:

• Post, upload, transmit, or otherwise make available any content that is unlawful, harmful, defamatory, infringing, obscene, or otherwise objectionable.

• Impersonate any person or entity or falsely state or misrepresent your affiliation with any person or entity.

• Interfere with or disrupt the operation of the Website and Mobile App or any servers or networks connected to the Website.

Donations and Financial Transactions

a. The Website and Mobile App provide a platform for users to make voluntary donations to creators. By making a donation, you understand and agree that:

• Bell3 is not responsible for the use or misuse of any funds donated.

• Donations are voluntary and non-refundable.

• All payments made on this Website and Mobile App are processed securely by Stripe, a leading third-party payment processor.

• Stripe utilizes industry-standard security measures to protect your payment method information and ensure a safe and secure transaction environment.

• You may be required to provide certain personal and financial information for the purpose of processing the donation.

• Bell3 may collect a processing fee or transaction fee for facilitating the donation, which will be deducted from the donated amount.

• The processing fee consists of a fixed amount retained for the purpose of covering both Stripe's and Bell3's chagers of 10,25% + 0.36 SGD per donation transaction.

b. You acknowledge that any financial transactions conducted on the Website and Mobile App are solely between you and the creator, and Bell3 is not a party to such transactions.

Intellectual Property

a. The Website and Mobile App and their content, including but not limited to text, graphics, images, logos, trademarks, and software, are the property of Bell3 or its licensors and are protected by intellectual property laws.

b. You agree that you will not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any content from the Website and Mobile App without the prior written consent of Bell3 or the respective rights holders.

c. By posting or uploading any content on the Website and Mobile App, you grant Bell3 a non-exclusive, royalty-free, worldwide, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the content in connection with the operation of the Website and Mobile App and their services.

Limitation of Liability

a. To the fullest extent permitted by applicable law, Bell3 and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses, resulting from your use of the Website and Mobile App or any content or services provided through the Website and Mobile App.

b. Bell3's total liability for any claim arising out of or in connection with these Terms or the Website and Mobile App shall be limited to the amount paid by you, if any, to Bell3 in the twelve (12) months preceding the claim.

Modification and Termination

a. Bell3 reserves the right to modify, suspend, or terminate the Website and Mobile App or these Terms at any time, with or without notice, for any reason or no reason.

b. If any provision of these Terms is found to be unlawful, void, or unenforceable, such provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of the remaining provisions.

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the low courts.
